There is a proposed Settlement of a class action lawsuit pending in the United States
District Court for the Central District of California (Western Division) entitled
In re Yahoo! Litigation, Case No. CV-06-2737 CAS (C.D. Cal.). The Court has
granted preliminary approval of the Settlement and has provisionally certified the
Settlement Class. The lawsuit alleges that customers contracted for targeted ad
placements through two products, “Sponsored Search” and “Content Match” (and predecessor
products provided by Overture Services, Inc. and GoTo.com, Inc.) and that Yahoo!
breached its contract with its customers by allowing Yahoo! ads to be displayed
in spyware, domain name parking sites (bulk registration sites), pop-ups, pop-unders
and typosquatting sites.
A definition of the Settlement Class and a description of the terms of the Settlement
are available in the Settlement Notice posted
on this site. You can also view Court Documents,
including the Settlement Agreement and the Court’s Order granting preliminary Settlement
approval. Additional information can be obtained by calling the Settlement Information
Center toll-free, at 1-877-434-3068.
As part of the Settlement, Yahoo! has agreed to provide the following Settlement
benefits: an Ad Placement Option, Enhanced Ad Placement Disclosures, Enhancements
to the Click Investigation Request Tool, and a $20 refund (“Refund”) to eligible
Class Members who are out of business.
The Settlement is not an admission of wrongdoing by any party.
